*Capt Rich Holds a Merchant Marine Masters Ticket (Captain – Sail & Power) for 40 years(currently active until 2021). He has traveled Central America, Leeward and Windward Islands including US and British Virgin Islands, Puerto Rico, Dominican Republic, Grand Caymans, Bahamas, and of course the US Coastal and it’s rivers, bays, and Intracoastal waters.*Rich is a Real Estate EXPERT on Waterfront, water view, Condos, homes, vacant lots, and commercial properties in the general Pensacola Area and S.E. Broker*: A licensed person who, for another, and for compensation, or with the intent to receive compensation, acts as an agent for others in the performance of one or more services of real estate, this includes transactions involving business enterprises or opportunities. In effect, the Broker is the top person, the Manager, of the Real Estate entity. Everyone must work for the Broker including “Sales Associates”, “Broker Associates”, and “generally” all office staff. The Broker “generally” has the Most Formal Real Estate Education certified by the State. (Captain Rich is a Licensed Broker – Few Florida Brokers have advanced college graduate degrees as Rich does)
Broker Associate: A person who has earned a broker’s License but chooses to be licensed as a broker Associate and operate as a sales associate registered with a broker.
Sales Associate: A person who performs any act specified in the definition of broker, BUT who performs such act under the direction, control, or management of another person (The Broker)
Customer: A member of the public who is or may be a buyer or seller of real property and may or may not be represented by a real estate licensee in an authorized brokerage relationship.
Principal: The party with whom a real estate licensee has entered into a SINGLE AGENT RELATIONSHIP.
Single Agent: A Broker who represents only ONE buyer or seller (lessee or lessor) per transaction, as a fiduciary, but not both in the same transaction. They are an “AGENT” of the Buyer or Seller (NOT BOTH in the same transaction) ONLY BROKERS may enter into agency and Non-agency relationships with Buyers and Sellers In a single agent relationship, a broker is a fiduciary and owes these duties to the Principal ONLY. The Broker is YOUR representative. You are responsible for the Broker’s Actions in your Real Estate transaction. Their specific duties to the Buyer or Seller owed by the Broker::
>Dealing honestly and fairly
>Confidentiality (MUST keep all information confidential and work SOLEY for the benefit of their principal: the Buyer or Seller (not both)
>Obedience (to all legal commands/requests)
>Use all skill, care, and diligence
>Presenting ALL offers and counteroffers in a timely manner, unless previously directed by Principal
>Disclosing ALL known facts that materially affect the value of the residential real property and are not readily observable.
Transaction Broker*: A Broker who provides limited representation to a Buyer, a Seller, or BOTH, in a real estate transaction, but does not represent either in a fiduciary capacity or as a single agent. This relationship causes the parties to a real estate transaction giving up their rights to the undivided loyalty of licensees. In Florida, under current law, ALL licensees are presumed to be transaction brokers unless another relationship is established in writing. This is the most prevalent form of brokerage relationship in the State of Florida.Under this relationship the Transaction Broker owes you:
>Dealing honestly and fairly
>Accounting for all funds
>Using skill, care, and Diligence in the Transaction
>Disclosing all known facts that materially affect the value of the residential
real property and are not readily observable to the buyer
>Presenting all offers and counteroffers in a timely manner, unless a party
has previously directed the licensee otherwise in writing.
>Limited confidentiality unless waived in writing by a party.
>Any additional duties that are mutually agreed to with a party.
NO Brokerage Relationship: The customer is NOT represented, the following duties are still owned by a real estate licensee:
>Dealing honestly and fairly
>Disclosing all known facts that materially affect the value of the RESIDENTIAL real property and are not readily observable by the buyer.
>Accounting for all funds entrusted to the licensee.
